Participation Terms and Privacy Notice - Food Furore Start-Up Pitch

1. General

1.1. These terms and conditions apply to the participation in the Food Furore Start-Up Pitch (the “Competition”). Prerequisite for participation in the competition is the confirmation that the conditions of participation have been read and accepted. This confirmation is made by submitting the completed application form. By acknowledging these conditions of participation and the subsequent submission of the registration form, the participants accept the following conditions.

1.2. Food Furore is an event organized by Coöperatieve Rabobank U.A., branch Frankfurt am Main, Solmsstraße 83, 60486 Frankfurt am Main and Coöperatieve Rabobank U.A. based in Amsterdam, the Netherlands, Postbus 17100, UC-B445, 3500 HG Utrecht (both together “organizers”). As part of the Food Furore event, this competition is organized by the organizers, together with and for our customers and cooperation partners, with the aim to draw attention to the problem of food waste and to provide a platform for start-ups with innovative solutions and approaches for the appreciation of food.

1.3. The pitches presented by the start-ups will be evaluated and awarded at the end of the competition.

 

2. Participants

2.1. Entitled to participate in the competition are start-ups with innovative and significant ideas and solutions for reducing food waste. Excluded are all companies which have a close economic relationship with the organizers, especially subsidiaries, sister companies and other group companies. The participation of minors (younger than 18 years old) in any way is not allowed.

2.2. There is no right to participate arising from the registration. The organizers reserve the right to reject participants at any time without giving reasons.

 

3. Start and end of Participation

The competition will take place on 26.03.2020. The deadline for submitting the pitch documents is 24.01.2020 via the website https://www.foodbytesworld.com/applytofoodfurore/

All applications submitted after this date will not be considered for participation.

 

4. Submission

The application is made exclusively by sending the pitch documents created by the participants and the completed application form via the website www.foodfurore.de/start-up. All requested information must be filled in completely and meaningfully. The personal data of the participants must be correct. Registration and participation in the competition is free of charge.
The organizers will not bear any costs for participation in the competition.

 

5. Procedure of the Competition

5.1 The competition is divided into three phases. They are structured as follows:

Phase 1: Preparation and submission of the pitch documents and the application form.
Phase 2: Selection of 6 finalist teams by a jury chosen at the discretion of the organizers.
Phase 3: Presentation of the pitches by the finalist teams followed by an award ceremony.

5.2. In the first phase, the preparation and the submission take place.

The preparation of the pitch documents must be done personally by the team. The pitch documents created must represent an independent performance of the participating team. Delegation of activities outside the registered team is not permitted. If a violation of this is found, the organizers can sanction this with the immediate exclusion of all participants of the team from the competition.

The team’s pitch documents must be submitted in their entirety, including the following information:

3. Contribution to the reduction of food waste
4. Team & Competences
5. Expectations of participation in the competition

The first phase ends on the day of the closing date on 24.01.2020.

In the second phase, the jury members select, at their own discretion, 6 finalist teams to participate in the third phase. The selection criteria used by the members of the jury to exercise their discretion include, but are not limited to, the business model, positioning and market opportunities, innovation potential, degree of maturity, and sustainability and societal impact on reducing food waste.

5.3. For all non-selected teams, the competition ends in this phase without receiving a prize. The teams will be informed via email about the participation in Phase 3 of the competition or their elimination from the competition until 03.02.2020.

5.4. The third phase is aimed at determining the winner within the group of finalist teams. The 6 finalist teams selected in the 2nd phase will be invited to a pitch coaching workshop as well as to the final selection to Berlin on 26.03.2020 (hereinafter “the final event”).

5.5. The final teams will bear the costs of participating in the final event themselves. The organizers will not pay for the participation, be it for travel or accommodation.

5.6. The Pitch Coaching Workshop will take place on 25.03.2020 in Berlin local time and will be conducted by professional coaches. It serves as preparation for the final event.

As part of the final event, the finalist teams will present their pitches to the jury, the other teams and the invited guests. The jury consists of one representative each from Rabobank, Hello Fresh, WWF Germany, kitchentown and the FoodBytes! Team.

The competition takes place in English with simultaneous translation. The language of the competition is English. The application documents must be submitted in English.

 

6. Prize

6.1. At the final event, the jury will select a jury-winner from the finalist teams at its own discretion, taking into account in particular the criteria listed in Section 5.2. In addition an audience award will be awarded by the visitors of the Food Furore. The audience award will be awarded to the finalist team that has received the most votes from the visitors of the Food Furore in a vote conducted by the organizers. The following prizes will be awarded during the competition:

– for all participants of the competition: access to the international FoodBytes! Community with the most up-to-date information on the latest trends and market opportunities for start-ups in the Food & Agri sector.

– for the finalist teams: Meet & Greet with Hello Fresh on 25.03.2020 in Berlin as well as a pitch coaching on 25.03.2020 in Berlin and pitch participation on 26.03.2020 in Berlin

– for the winners of the jury award: Food Furore 2020 Jury Award and Wild Card for FoodBytes! London 2020 and provision of a Co-Working Space (Hot Desk) for two months in Berlin selected by the organizers incl. access to the kitchentown Start-up Community, including the payment of any rental costs and membership fees incurred.

– for the winners of the audience award: Food Furore 2020 Audience Award and provision of a Co-Working Space (Hot Desk) for two months in Berlin selected by the organizers incl. access to the kitchentown start-up community, including the rental costs and membership fees which may be incurred for this.

6.2. The winners will be announced at the event following the presentations of the finalist teams.

 

7. Rules of conduct

7.1. The participants assure that they have all rights to the contents of the submitted pitches and that no rights of third parties are violated.

7.2. In connection with the creation of the pitch, the participants shall refrain from using any content that is unlawful and / or contrary to moral standards and / or in accordance with the organizers’ decision considered as obscene, defamatory, defamatory, offensive, pornographic, harassing, racist, xenophobic or are otherwise objectionable or that may damage or damage the reputation of the organizers.

7.3. However, if third parties, including state institutions, assert alleged rights to the pitch content or any other unlawfulness of the pitch content to the organizers, the participant will indemnify the organizers against these claims, in the case of legal defense (to which the organizers are entitled but not obliged) provide the necessary support and exempt them from the costs of legal defense. The prerequisite for this is that the organizers inform the participant of asserted claims without delay in writing, make no concessions or acknowledgments or equivalent declarations and allow the participant to conduct all judicial and extrajudicial negotiations on the claims at his own expense.

8. Compliance with the Terms of Participation

8.1. The organizers reserve the right to exclude participants from the competition if they do not comply with these conditions of participation or if they violate equal opportunities and rights for all participants.

8.2. The exclusion from the competition as well as the blocking, removal and deletion of submitted pitch content and data can be done at any time without hearing the participants concerned. Any claims against the organizers for the exclusion from competition or the blocking, removal or deletion of pitch content and data are excluded.

8.3. Incorrect statements, failure to comply with assurances in accordance with these conditions of participation, infringement of third-party rights and other legal violations as well as repeated participation in the competition in any form shall entitle the Organizers to exclude the respective participant from further participation even during the ongoing competition. The same applies if there is any reason to fear that the conduct of a participant or the other reasons relating to the participant could damage the image or the good reputation of the organizers, this competition or of affiliated or contracted companies.

 

9. Rights of Use

The intellectual property rights of pitch content that may result from the pitch creation shall remain with their original copyright owners. There is no automatic transfer of rights of use to the organizers.

 

10. Liability of the Organizer

Claims of the participants for damages against the organizers are excluded. This does not apply to claims for damages of participants arising from injury to life, limb or health as well as liability for other damages that are based on intentional or grossly negligent breach of duty by the organizers, their legal representatives or vicarious agents, as well as claims for damages that are based ob a legally non-negotiable liability, in particular under the Product Liability Act. Furthermore, the liability for the violation of obligations, the fulfilment of which is essential for the proper execution of the competition and on the observance of which the participant may regularly rely (hereinafter: “cardinal obligations”) remains unaffected. In the case of a slightly negligent violation of these cardinal obligations, the organizers shall only be liable for the contractually typical, foreseeable damage, unless it is a matter of the participant’s claims for damages arising from injury to life, limb or health.

 

11. Data privacy

11.1. The organizers are responsible for processing the personal data provided by the participant. The organizers have appointed a data protection officer, who can be contacted DPO Service GmbH, Bethmannstraße 50-54, 60311 Frankfurt am Main, E-Mail: datenschutz@DPOservice.de

11.2. When applying and participating in the competition, the organizers collect the personal data of the participants, which they make available to the organizers. This includes in particular the contact data from the application as well as the production of video-and audio recordings during the final event..

11.3. The organizers use the data provided for the competition in accordance with the provisions of German and European data protection law. The organizers will process the personal data as far as this is necessary to establish the legal relationship with the participant as well as the subsequent implementation and execution of the event, in particular to process the application, to contact, to confirm or to prepare the eventual participation and the execution of the competition (Article 6 (1) (b) GDPR).

The organisers will process the personal data, in particular the names as well as the photos and videos of the participants, for the purpose of reporting on the event, for example in social media and on their websites (Art. 6 para. 1 lit. f GDPR). The organisers have a justified interest in the publication of reports on the event, which also contain information on the participants. The interests of the participants are also not unreasonably affected by the reporting.

The organizers will store the personal data to the extent and as long as this is necessary for the aforementioned purposes. A longer storage period may result, in particular, from statutory retention periods (in particular according to HGB and AO). In this case, the storage is based on Art. 6 para. 1 lit. c GDPR.

11.4. Personal data will not be disclosed to third parties.

11.5. The participant has the right to request information about the personal data stored by the organizers free of charge (Art. 15 GDPR). The participant also has the right to request the correction, deletion or restriction of the processing of his personal data (Article 16-18 GDPR) and the right to receive such data in a structured, common and machine-readable format (Article 20 GDPR). The participant can send such requests to the above address or to datenschutz@rabobank.com. If the participant is of the opinion that the processing of the personal data concerning him by the organizers is contrary to the relevant statutory provisions, he may also turn to a supervisory authority, in particular in the member state of his place of residence or the place of the alleged infringement.

12. Right to your own image

12.1. The participant agrees that his / her person may be depicted in photographs and videos intended for distribution by the organizers. This includes above all photos and videos during the event in the third phase of the competition and its distribution through all media, including social media (especially Twitter, Facebook, etc.).

12.2. The participant has the right to reject the presentation of his person in an informal written communication.

 

13. Right to name recognition and reporting

Each participant further agrees that in the event of his / her participation in the final event, the organizers have the right to name the finalists in all media, including social media (in particular Twitter, Facebook, etc.) or elsewhere and to report on the individual participants in connection with the third phase of the competition in all media (in particular journals) or elsewhere.

 

14. Final Provisions

These conditions of participation and the resulting legal relationship are subject to the law of the Federal Republic of Germany to the exclusion of all provisions of conflict of laws which refer to another governing law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply on these terms. Any recourse to courts of law shall be excluded.
Furthermore, the organizers reserve the right to prematurely terminate, discontinue, supplement or modify the competition, in whole or in part, at any time, even without observing deadlines and without stating reasons, . The participants cannot derive any claims from this.
Should individual provisions of these conditions of participation be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
